Every beneficiary of a federal program could run into court, point to an agency’s general discretion to prioritize funding, and claim that failing to prioritize their chosen program was arbitrary and capricious.”

Respondents’ attorneys countered that over 40 million Americans reliant on SNAP had gone more than a week without essential assistance for food:

> “Any further stay would prolong that irreparable harm and add to the chaos the government has unleashed, with lasting impacts on the administration of SNAP. The government has offered no defensible justification for that result. The administrative stay should be terminated, and no further stay should be granted.”

> “The district court is commandeering sensitive funding-allocation decisions in the middle of a shutdown, in ways that frustrate efforts to end that shutdown and result in new appropriations for all of these programs. This Court has not hesitated to intervene in similar cases where the lower courts have commandeered the Executive’s prerogatives over allocating limited resources.”

> “The government’s remaining claim of irreparable harm, that the district court’s orders are interfering with negotiation tactics in the government shutdown, only confirms what has been clear all along—that the government is leveraging SNAP to gain partisan political advantage in the shutdown fight. This Court should not participate in that effort. There is no justification for the Court to step in to stop needed benefits from flowing to the children, seniors, low-wage workers, veterans, and others who rely on them for food.”

Sotheby’s says a diamond brooch lost by Napoleon as his forces fled Waterloo sells for $4.4 million

GENEVA (AP) — A diamond brooch that French Emperor Napoleon lost while fleeing from the Battle of Waterloo in the early 19th century sold for more than 3.5 million Swiss francs (about $4.4 million) at a Geneva auction on Wednesday, Sotheby’s announced.

The brooch, which can also be worn as a pendant, features an oval diamond weighing over 13 carats surrounded by smaller cut diamonds. The sale price vastly exceeded the high end of the pre-sale estimate of 200,000 francs. The hammer price was 2.85 million francs, excluding fees and other charges that were included in the final aggregate price.

According to Sotheby’s, the circular jewel was discovered among a stash of Napoleon’s personal belongings found in carriages that became stuck on muddy roads as he and his troops fled the Duke of Wellington’s British forces and the Prussian army under Field Marshal von Blücher.

For more than two centuries, the jewels were part of the heirlooms of the Prussian Royal House of Hohenzollern. Sotheby’s did not disclose the identity of the seller and said that the buyer was a “private collector.”

Among dozens of lots on the block was a green beryl weighing over 132 carats, which Napoleon was said to have worn at his 1804 coronation. The jewel sold for a hammer price of 838,000 francs—more than 17 times the high-end pre-sale estimate.

One diamond expert noted that the sale carried added allure following the much-publicized robbery of Napoleonic jewels from the Louvre Museum in Paris last month.

“Given the recent Louvre heist and the provenance of arguably the most famous French figure in history, I’m not surprised the jewel achieved a majestic 3.5 million francs,” said Tobias Kormind, managing director of online jeweler 77 Diamonds. “The brooch arrives at a moment of renewed global fascination with Napoleonic jewels, and its story is irresistible.”

Later on Wednesday, Sotheby’s held a “high jewelry” auction featuring a 10-carat pink diamond tentatively known as the “Glowing Rose,” which is expected to fetch about $20 million. The stone was unearthed in Angola’s Lulo mine.

Watch: Alligator spotted swimming in Boston’s Charles River

Nov. 12 (UPI) — Wildlife authorities in Massachusetts are searching for a small alligator caught on camera in the Charles River by a couple walking in Boston.

Trevor Rochelle captured the video over the weekend when he and his girlfriend spotted the alligator during a walk alongside the river. Rochelle noted that the reptile was initially not moving but retreated into the water when he poked it with a stick.

Several other alligator sightings have been reported in the same area in recent days. In response, the Massachusetts Division of Wildlife, Boston Animal Control, and Massachusetts Environmental Police are working together to locate and capture the alligator.

The origins of the reptile remain unknown, but alligators are illegal to keep as pets in the state. MassWildlife officials also indicated that the alligator would be unlikely to survive for very long given the upcoming cold weather.

Democrats Shift Media Focus Back To Jeffrey Epstein With Email Release Of Claim Trump “Knew About The Girls”; White House Calls It A “Fake Narrative”

House Democrats shifted media attention back to the Jeffrey Epstein files on Wednesday with the release of a series of emails claiming that Donald Trump had more knowledge of the convicted sex offender’s conduct than previously disclosed.

In one of the emails released, Epstein wrote to Ghislaine Maxwell on April 2, 2011: “I want you to realize that that dog that hasn’t barked is trump.. [Victim] spent hours at my house with him ,, he has never once been mentioned. Police chief. etc. im 75 % there.” Maxwell replied, “I have been thinking about that.”

In another email, dated January 31, 2019, Epstein wrote to journalist Michael Wolff, “[Victim] mara lago. [identifier]. Trump said he asked me to resign, never a member ever. Of course he knew about the girls as he asked ghislaine to stop.”

CNN and MSNBC gave extensive coverage to the email release this morning, while Fox News provided less focus on the story. However, Democrats appear to have timed the release around the pending swearing-in of a newly elected House member, Democrat Adelita Grijalva of Arizona. She will provide the crucial 218th signature on a petition to force a vote on the release of the Epstein files.

House Speaker Mike Johnson has declined to seat Grijalva while the House has been out of session during the shutdown, but representatives are scheduled to vote later today on a resolution to reopen the government.

Rep. Robert Garcia (D-CA), the ranking member of the Oversight Committee, said in a statement: “These latest emails and correspondence raise glaring questions about what else the White House is hiding and the nature of the relationship between Epstein and the President.”

Republicans on the Oversight Committee responded with a statement saying, “Democrats whine about ‘releasing the files,’ but they only cherry-pick when they have them to generate clickbait.”

The GOP also revealed that the redacted name of the victim referenced in the emails is Virginia Giuffre. According to CNN, Giuffre said in a 2016 deposition that she “never saw or witnessed Donald Trump participate in those acts, but was he in the house of Jeffrey Epstein? I’ve heard he has been, but I haven’t seen him myself, so I don’t know.”

White House Press Secretary Karoline Leavitt issued a statement saying, “The Democrats selectively leaked emails to the liberal media to create a fake narrative to smear President Trump.” She also noted that the ‘unnamed victim’ referenced in the emails is Virginia Giuffre, “who repeatedly said President Trump was not involved in any wrongdoing whatsoever and ‘couldn’t have been friendlier’ to her in their limited interactions.”

Trump himself has acknowledged his relationship with Epstein but said they fell out of favor. “The fact remains that President Trump kicked Jeffrey Epstein out of his club decades ago for being a creep to his female employees, including Giuffre. These stories are nothing more than bad-faith efforts to distract from President Trump’s historic accomplishments, and any American with common sense sees right through this hoax and clear distraction from the government opening back up again.”

Another email released on Wednesday, dated December 16, 2015, shows an exchange between Wolff and Epstein regarding Trump’s pending appearance on CNN.

“I hear CNN planning to ask Trump tonight about his relationship with you—either on air or in scrum afterwards,” Wolff wrote.

Epstein replied, “if we were able to craft an answer for him, what do you think it should be?”

Wolff responded, “I think you should let him hang himself. If he says he hasn’t been on the plane or to the house, then that gives you a valuable PR and political currency. You can hang him in a way that potentially generates a positive benefit for you, or, if it really looks like he could win, you could save him, generating a debt. Of course, it is possible that, when asked, he’ll say Jeffrey is a great guy and has gotten a raw deal and is a victim of political correctness, which is to be outlawed in a Trump regime.”
